Why Might a Lease Not Be Available?

However, a lease is not always available from HM Land Registry records.

What is a lease?

• service charge or ground rent provisions
• restrictions or obligations affecting the property

For leasehold property, the lease can be an important supporting document alongside the Title Register.

Why might a lease not be available?

A lease may not be available for several reasons.

This can happen if:

• HM Land Registry does not hold a copy of the lease
• the lease is not available electronically
• the lease is too large for immediate digital supply
• the property is not leasehold
• the wrong title has been selected
• the lease has to be requested manually
• the property is unregistered

Does every leasehold title have a lease available?

No. Even where a property is leasehold, this does not always mean a digital copy of the lease is immediately available.

Some leases are old, lengthy, scanned, unclear, or only available through additional processing.

What happens if the lease cannot be supplied?

If you order a lease and it is not available from HM Land Registry records, we will let you know.

Where a search has been carried out but the lease cannot be supplied, we may issue a partial refund in line with our refund policy. The retained amount covers the search and administrative work carried out.

What if I need the lease urgently?

If you need a lease urgently for a property transaction, legal matter, court use, or formal evidence, you should contact us before ordering.

Some lease requests may require additional official-copy processing and may not be available within the standard delivery timeframe.
